A new and challenging aspect to law enforcement and public employees at large is the First Amendment Audit experience in public buildings and public spaces. Being prepared to respond to an audit is of the utmost importance to those in the public arena. This training addresses all aspects of a First Amendment Audit from the legal basis (statutes and case law) to the forum where it is carried out, to the practical and proper response of law enforcement. The recommended audience for this training is dispatchers, officers, supervisors, and command staff. Attendees will be given information and advice in the following areas:
· First Amendment basics and how filming fits into it
· The importance of the location (forum)
· Limitations on the First Amendment (time-place-manner, protected and non-protected speech)
· Types of Audits (1st Amendment, public records, public meetings, policing)
· Process of Audits (notice factor, recording aspects, educational aspect, documentation)
· Legal Parameters (permitted activities and restrictions)
· Who are the auditors (individuals and organizations)
· Response Guidelines (acceptable verbiage, access/limitation conversations)
· Common complaints to Audits
· Impact of Audits (training, transparency, policy development, accountability)
· Posting of Information in public buildings to avoid or mitigate an audit (sex offender information, complaint forms, Records Access Officer, etc.)
· What to do when the auditor will not leave (potential charges)
· Lessons learned from recent audits
